bail and bond

Querist : Anonymous (Querist) 16 November 2009 This query is : Resolved
what is the deference between bail and bond?
A V Vishal (Expert) 16 November 2009
Bond: A financial obligation that guarantees a person's future appearance in court.

Bail: release after a security has been paid, deliver something in trust to somebody for a special purpose and for a limited period.

Thus in a layman's language bail is the end process and bond is a tool to seek it.

Unfortunately both these terms are not defined in our legal system & law books.

In a criminal case these two words are used.
Bail means: A person who committs an offence will be released from the juidicial/police custody by imposing some conditions. This release is bail.
Bond : When accused releases on bail accused has to provide the adequate surety to ensure his availability to the court on all the adjournment. Such surety has to provide the security to the court by exeucting a bail bond. In case accused violates the conditions imposed by the court and failed to appear before the court, notice will be issued to the surety to pay the bail bond amount.

Bail is something which direct the jail authority to set free the person who is in jail on certain conditions. The bond is the financial guarantee to the court of the person who has been enlarged on bail to the effect that the bailout person shall appear before the court as when required. Its a financial check on the person who has been enlarged on bail.

I have no different opinion as of all other senior experts in this common and simple subject.
