Rectification deed

My father transferred his property to my mother by executing settlement deed. now we have noticed that one of the boundaries had been wrongly mentioned in the settlement deed. But the same is mentioned correctly in the sale deed when my father purchased the property.

my father is no more now. can my mother execute Rectification deed. If it is not possible then is there any other means by which necessary correction be made with regard to the boundary.

Get a deed of declaration executed by your mother.

All other legal heirs of your father (now deceased) can either execute a Deed of Correction before the same registrar or a suit for declaration can be got filed by your mother against all other legal heirs of your deceased father and thus a declaration can be got obtained from the civil court in this regard.

A suit for declaration before a court will take a very long time, instead, all or the surviving legal heirs of your father excluding your mother can execute a rectification deed to the settlement deed rectifying the error, which will be a more feasible solution.
