Travel agent fraud

Hi,
I have been booking tatkal tickets through one of ticket agent in bommanhalli bangalore. Sincce he booked my last three tickets, i have started trusting him regarding the money. This time also he asked to deposit the amount in the account ,before booking the ticket. He was not able to get confirm ticket frst time, i asked him to book another day, he was suppose to book the ticket yesterday ie. 26 May 2014, he messaged me that the ticket didnt get confirmed but he is trying to get it confirmed through VIP kota, i have been trying to reach him but he is not responding, i messaged him to return my money back but still no response.

Can i file a case against the agent, i have only sms as proof which i can show. I never use to take any receipt from him as this was only through calls and sms and he use to send me tickets through email.

Any help regarding this will be helpful.

yes, you can file criminal case of cheating.
You can fie case in consumer forum as well.

Better wait for some time and try to contact him and ask to return the money.

Gather the proof regarding the money paid in his account and he tried to book the ticket in your name.

If he fails to return your money, send legal notice.

Agreed with Mr. Goyal and Jaggarao Sir. Taking legal actions are open for you. There is no need to start that process right now, try to contact him first. Or else he will definitely contact you.

A consistent contact and talks for refund will save you from spending more money for getting refund or the money with him, settle the issues amicably, only if you find he is adamantly reluctant, you may opt for legal action. A travel agent will not spoil his business over such tiny attractions, wait for him to reply or confirm.
