dear experts,
the court has ordered compensation under dv act. my client (respondent)has paid 70%. tomorrow i want to file an application for granting some more time to pay the balance amt.
pls suggest any case law in this regards. and the provision under which i can ake the same. the judge on the previous date was not willing to accept 70% of the amt.

There is no separate law of this. As a matter of judicial discipline and practice, the court does grant time to make payment of arrears amount in installments. It is quite commonplace in all courts of India.

As advised properly by expert Mr.Barman, it is discretion of the court and generally the court does allows such issues on merits based on the arguments. You cannot find a citation for such things.
