Legally whom can i safely depend on registering my property

Hi,

I'm married & have no kid yet. My parents reside at my native place, i have only one elder sister who is married & have a kid, she resides with my parents. Now, i have booked a property at my native for which property registration needs to happen next month. But due to business reasons i will be flying to US next week for a period of 4 months. since i'm not available in india, i need to register this property on some one's name. I'm thinking either to register either on my father or my wife's name. Legally who would be more safer so that i can register property on their name?

You can give GPA to even stranger also.
So go ahead with anyone you choose. Law does not make any difference in such matter.
I would advise you to choose either of the two.

Better get it registered in your name by giving a GPA to any of your near relative,

if the property is registered with anyone's name other than you then you treat it as charity and forget about the property.

GPA can well register the property in your name. He will represent you only as your constituted attorney not himself/herself.
Your name would appear as purchaser not his/her.

dont register property in name of your father or sister . you can postpone your business trip . or when you return you can do the registration .

in the alternative you can give specific power of attorney yo your father for registration purposes

POA suggested would also require registration.
It is always best to register the property in your own name.
You shall not be treated owner if you choose to get it register in name of your wife or mother,father or any relative.

Legally owner is one in whose name property stands registered,no matter how and from which source consideration came.
Hence better not to invite future litigation if you intend to own.

The best solution is that you can defer the process of registration until you return to India after your trip to abroad.

As well advised Mr.Ajay Sethi and Senior Expert you register the POA for specicific Purpose and get the Property registered in your name even in your absence.The way the prices are hiking in Real Estate better not to delay the process for the reason of your non availablity giving any chance to the seller for any second thought.You could appoint an advocate to monitor the process
