Non returning of advance amount by land lord

Dear Sir,
In July 15th 2013, I was in search of house and I paid Rs.50000 through bank cheque as advance (towards the lease amount of Rs 13 Lakh) to land lord, in bangalore. After 2 days, since, I could not able arrange the amount due to some reasons and I communicated the landlord on my situation and considering his age( >60), I agreed to wait for my advance amount until some one comes to that house. After 3 months some one came and even after 10 months, he is not willing to pay my money of Rs50,000. Even after several reminders and requesting him to pay atleast in instalments, he is not willing to return the amount. I have only proof that, before paying advance, he shared the lease document template to me via email and I paid him the amount through bank cheque. My question is , can I put a case against him and these docs are considered as proof ? Can you please help me

Yes, show all relevant documemnt and issue legal notice through (your) local lawyer and file suit for recovery of money.

This os cheating and criminal breach of trust. You can contemplate to file such cases if he is so unwilling to return you money.

Send a legal notice and file suit for recovery of money apart from the criminal complaint.

First consult a lawyer and send a legal notice demanding your money and base on his reply, you can decide about next course of legal action. The documents in your possession are sufficient to prove the legal transaction between you both.
