Cs 15 months training

Guest (Querist) 12 February 2014 This query is : Resolved
Dear Experts

Please guide me. I am undergoing 15 months training in a Company and have completed 9 months. My appointment letter says that if I plan to leave, I will need to serve a notice period of 30 days. Just to inform you that I am expecting and hence would not be able to continue the training as the office is quite far and the journey involved is too long. Please confirm if I need to serve the notice period in order to get an NOC OR I can get the same without any notice period.

I know my Sir will make my life miserable because since the time I have joined, he puts all on the work on me and doesnt involve himself much. He wouldnt want me to leave the company. But my life is taking a new turn and I do not wish to do anything that will affect my unborn baby.

I also do not regret quitting because the work that I mostly do in this Company is in the nature of clerical work as it involves mostly printing, scanning etc. Not much exposure.

Please reply. I need your assistance.

Nobody can force you to continue with a job. You are free to leave the job giving 30 days notice period or even without it.

Better give one month notice as agreed. If you think it will not be practicable for you, you should send resignation and if any demand comes oppose it. Maximum you may have to pay one month pay in lieu of notice period.

@ Author If you are not able to learn any thing better quit that place. You strictly tell your boss you would not do any thing other than R.O.C.jobs.Better send him the 30 days notice immediately.Try to sort it out amicably other wise Legal protection is always there for you.

Thank you so much for your reply experts. Today I just went through my appointment letter and it says that ''Either party may terminate the contract by serving one month's notice period or the stipend in lieu thereof''.

If I tender my resignation on 16.02.2014, I assume that my last working day will be 03.03.2014 as I am serving notice period for 15 days and not taking my stipend for the first 15 days (01.02.2014 to 15.02.2014).

Please correct me if I am wrong.

Thank you

Your department may not permit to serve notice period in part. If it permit so it is excellent.

surrender either full stipend of a month or give full 30 days notice.
part of stipend and part of notice period will not be accepted .
read your appointment letter once again.

In this case I assume that I can give my resignation on march 1st and let go of my feb stipend.

Pls clarify if my understanding is correct.

Thanks for all your replies.

yes. pl. write to your company referring your appointment letter and about your intention to resign and surrender of full month stipend in lieu of one moth notice period.
if possible state in your letter the circumstances leading to your inability to give one month advance notice.be polite and ask for immediate relief from service and also ask for a service certificate.
