my question is
i have not transwered that property in my name so far, can i make a will without transwering that property in my name

Yes you can make a will without transwering that property in your name. Mention in your will that you have owned that property by way of will from your mother.
Raj Kumar Makkad (Expert) 01 November 2009
You have not provided any information about your mother whether she is alive or not? In case she is alive, you cannot think of makin any will. In case she is not alive even then directly you cannot make will of the property left by your mother in favour of your sons without first getting it probated in your name and getting its execution. No chance of direct will in both cases.
Adv Archana Deshmukh (Expert) 01 November 2009
Get the property transferred in your name first and then make a will in favour of your son.
