Since last 3 years my wife is staying with her parents in another city. 1 year before I filed a divorce case and after that she filed a dv case on me. Now she is asking me to provide her shelter in the city in which I stay in the name of education of child. At present I'm staying in a house provided by my father and I'm financially very weak to provide her any shelter. I'm already paying her the maintenance with great difficulty. What can be done in this case?

Under Dv act she has right to stay in shared household . if you dont want to stay with her she can claim alternative accomodation .
you have not mentioned what is your salary and what maintenance you are paying for wife and child .
whether maintenance amount is sufficient to pay rentals for shelter in city wherein you are staying ?

from 2/3 years because of mental tension i had lost my all business and now i am totally dependent on my father,and i am paying her 5000 rupees per month in divorce case and she has again asked for separate interim maintenance in dv case along with shelter but i am ready to keep the child with me and to prove him proper education in the city where i stay

draw attention of DV court to orders passed in your divorce petition . court will consider said fact that you are paying Rs 5000 per month while passing orders . you may have to provide her shelter

All husband facing mtn says, he lost job/ business due to mental torture/ tension.
Court ignores such excuses.
Unluckily, these are women oriented laws.
Even able bodied uneducated " house maid: earns 10k p.m. easily "
Why Laws ignore it, is big Q.
All able bodied man and woman must be considered Equal, for Equality at Law and justice.
Analysis of Indian Matrimonial cases in court can reveal this fact.
So that such Matrimonial disputes and cases will reduce.
Otherwise, in no time, majority of wedding couple will be seen in Court.
Any compensation & mtn should not exceed the number of months she served as wife!!
Otherwise Ladies will take full advantage getting married to top earner, and go to court in few months!! It had become a business now.
The catches are top earner, seamens, foreign employed, rich businessman,

She is entitled for housing, if shared is not possible separate, education of child is in the same town.
Custody of child is generally with the mother, father can get only visitation charges.

sir she is only entitle for shelter or separate house if she want to gave education to child in the same city where i stay ?? at present she stay with her parents in another city
