Order reserved in judicial proceeding at admission stage

My querry, is in a judicial proceeding the order is reserved at the admission stage on the point of admitting the petition without giving a further date.
As per CPC when judgement is reserved it should be delivered within 60 days.
In the present case the 60 days time is already over. Whether at this stage an application citing the above provision of delivery of judgement on being reserved, or a simple application praying for delivery of the order reserved be preferred.
Please advice early.

my matter is an Appeal before the Divisional commissioner, under a new act which says that any proceeding under this act is a judicial proceeding. All other proceeding before the divisional commissioner comes under quashi-judicial proceeding,.
Now the question arises how can a admistrative officer is given the power to preside over a proceeding which is defined as a judicial proceeding under the Act.

You are putting a new question. In your original question you have asked how a case can be reserved with out justification for more 60 days.
Ensure you will not come with any more questions so that we can give our opinion once for all.

If the provisions of Act so allows, such powers / proceedings are legal till decided otherwise by the competent Authority.

I totally agree with Mr Goyal, in that case although the Divisional Commissioner has been entrusted with presiding with a judicial proceeding under an Act called Land Dispute Resolution Act 2009, and since this is a civil nature proceeding the CPC will have to be followed, where the rules framed under the said Act is silenton this point.
