(Querist) 19 November 2013 This query is : Resolved 
Sir as per your direction I am stating facts ;

Mr. A and Ors are the Tenants. Now their premises redeveloped by the Builder. After redevelopment Mr. A has been allotted the Flat since he was the Tenant.

Query : i) Whether Stamp Duty is applicable when title is not transfer?

ii) Whether Mr. A has to pay the Stamp Duty or not?

There is no clause for stamp duty in Agreement.

If Stamp Duty not paid then what happen?

It is requested kindly provide the answer.

there must have been a written agreement between builder and tenants for redevelopment. agreement would have to be stamped and regd . if builder is not willing to pay stamp duty A should pay

If nothing contained in the redevelopment agreement A has to pay the Stamp duty.
