(Querist) 21 October 2009 This query is : Resolved
Dear all,

Our company's driver damages a electricity pole and transfarmer five days before in saving a cattle on the road. There is not any FIR by villagers or electricity board till now.

Is there any provisions, so can villagers or electricity board can recover damages from us. If they can file any FIR now. What remedies avaiable to our company

Regards,
Manish

Dear Manish,
Till now if no FIR filed then its good. filing of late complaint is not entertained in law, so no need to worry. Contact KEB and keep silent as to the drivers act, but request them to repair the same as like a normal griveancer.

Joyce is advised correctly

I beg to differ on the advise given by the experts, here the property destroyed is a public property and simply just because there is no complaint or delay in filing the complaint does not absolve the company from the act of destruction of public property which is by itself a criminal offence.

I go with vishal. If any compensation can be filled, better deposit with electricity board so that damage may be cured.

agree with Mr Vishal
