Motor vehicle

(Querist) 06 October 2013 This query is : Resolved 
R/sir,
The four wheeler goods carriage motor vehicle met an accident.The said accident occurred due to natural calamities.One big tree collapsed upon the vehicle of which resulting damage to the vehicle worth Rs.25,000/-.
Applicant met insurer but he refused to grant claim on the ground that renewal in respect of passing and permit of the vehicle has not effected.But fact is that,at the time of taking out insurance passing and permit was also not effected.
Now where should I move claim application, before Claims Tribunal or Consumer Forum?
(S.165(1)of the M.V.Act speaks about property of third party)

You being insured should move before consumer forum in the given facts.

If the Lok adalat (Public Utility services) exists in your district you may also move to that otherwise Consumer Forum is the way.

Permanent Lok Adalat for Public Ulity Services has also started working in many districts so if this facility is available in your district, avail it.
