Change of property ownership

Hello Sir

We bought a flat as joint owners, thats me and my younger brother and the property is in our names, now we want our elder brother also to be one of the owner in it, what is the process, do we have to get any deed and do the registration process again or will any power of attorny signed by me and younger brother do.

yes u have to do an agreement with ur elder brother. along with agreement deed and individual affidavits also requsting application for inclusive of owners name can be given before the concerned authority.

Rectification of sale-deed, or agreement deed which is allready registered can be made and attached to the original one. during rectification edit an add ur elder bro name.

In my opinion you have to execute a New deed. You want to add an additional new owner in the title deed. It can not be done by the Rectification of sale-deed, as it is not a mistake. In Rectification deed the errors may relate to the name of the parties, their address, area of the property, dimension, location, survey number of the property, or the consideration amount. There can be typing errors or errors because of improper comparison with the property documents like the transfer deed, sale deed, title deeds and revenue records.
You can not introduce a new owner in the Rectification deed.
