Employer forcing me to quit

(Querist) 05 August 2013 This query is : Resolved
Hi,

I work in an IT company in Bangalore (have offices in Chennai/Mumbai/Hyd/Delhi) as a Project Leader for the past 3.5 years. My project got over by July 2nd week. My employer doesn't have a project for my skillset (Mainframe). So, our team is on bench for 2 weeks. Now, our employer asks us to give resignation. The reason he says is company has no mainframe projects. So, they can't put us in any project. My question is why the employer asks us to resign instead of terminating us? What are cons if the employer terminate us? What's the advantage the employer has by asking us to resign instead of terminating?

Thanks,
Buggy

if your company dosent have any work and your employer wants you to resign better do so . take your relieving letter and leave amicably . read term and conditions mentioned in your appointment letter . does it provide for 3 months pay in case your services are terminated ?

Ask your employer to give a written notice for termination instead of asking for resignation. Alternatively, you may give notice for resignation taking due care of the prescribed notice period failing which you will have to pay to the company for period short of the prescribed notice period.
