Can i get my share legally

(Querist) 25 April 2013 This query is : Resolved 
Dear Sirs,

My Grandfather ( mother's father ) is having some 30 acres land & houses in Andhrapradesh. My mother got married in the year 1972. Now we live in karnataka. Is myself or my mother are eligible to get the share in the property legally.

your grandfather is still alive . if it is self acquired property he can by will bequeath it to whom soever he desires . in case your grand father dies without a will your mother as one of legal heirs would be entitled to her share

If the questioned property is self acquired property of your grand father then in his life time your mother can not claim any share.your grand father can sell,gift or transfer the same as per his wish and in case he dies intestate then your mother can claim her share as per law.

You have not provided certain facts:

1. Whether your grand father is still alive or not?

2. what is the source of the acquisition of that property by your grand father?

3. Whether your grand father died intestate?

1) My Grandfather ( Mother's Father) expired 35 years ago

2) My grandfather earned the property by his own efforts.

3) As per my knowledge he has not prepared any will,
