Tenant not vacating the property

(Querist) 10 March 2013 This query is : Resolved
Please help me,
I have given my property on rent for a medicine shop 3 years ago for 10 years.
Now i want that property vacated for reconstruction.
But the tenant is not vacating. 3 months ago i gave legal notice to him for vacation on the ground of arears of rent from 2 years...
now he is saying tha he will vacate the house after 3 or 4 month but i cant wait till that day. because i have to construct that house for self residential purpose, and i haven't any other residential house. So i am very need full of that vacation. So please help me what can i do for vacation. And how many days i have to wait for that.

If the tenant refuses to vacate the property then only option left to the landlord is to file suit for eviction which would take may time more than that 3-4 months you are given now.
You better cajole your tenant to leave the premises at least after 3-4 months.

IF he vacate the house after 3 or 4 month,
U R VERY LUCKY.
NO REMEDY TO YOU TO VACATE TENANT WITHIN 3 MONTHS

Land lord can not forcefully dispossess tenant on expiry of the term of tenancy.Filing a suit of eviction is the only remedy but such suits take surprising time and pend for decades in court, then it is better be strategic and persuasive with him about your difficulties and get it vacated accordingly instead of opening a war in courts.

thanks to all of you.
As you told me the Suit process is lengthy,i have no other option.
I will try to resolve this by mutual consent.

Yes! That would be a right way.

Most welcome you are!

you must have entered into agreement to give premises on lease for 10 years . the agreement must be containing clause for termination of lease . f lessee want 4 motnths time better give him that much time or you will be running around court for years
