State full facts of the case, if there is any problem. Even otherwise, while section 58a is quite clear, your Chartered Accountant and the Company Secretary should also have necessary knowledge, if actually your company wants to accept deposits from some public company.

RBI Guidelines have specifically issued in such matters. NBFC is required to be formed prior to acceptance of even a single penny from general public so better to visit the official site of RBI.
