Government job and 498a

Guest (Querist) 17 September 2012 This query is : Resolved
I am a central government employee.
Already I posted the FIR copy to my top authority and got the acknowledgement.

What is the drawback for me being a central government employee?
1)In case of suspension after arrest I will get 50% of salary.
2)After case is over I will get remaining 50% of salary and continuation of previous job.

Please enlighten me.

Yes if you are taken into custody for more than 24 hours then you would be suspended though you would continue to receive the suspension allowance.
However in appropriate cases the court/tribunal may reinstate you even before completion of trial.

You were only required to intimate arrest / detemntin and bail. Copy of FIR is infructuous exercise you have done.

Your questions are attempted as under

1)In case of suspension after arrest I will get 50% of salary.

Ans : If remaining in custory for 48 hours (not 24) you are deemed suspended and entitled to 50% of basic + DA HRA full and Tpt allowance Nil.

2)After case is over I will get remaining 50% of salary and continuation of previous job.

Ans : Only if acquitted and that too on mertis of the case not on prcedural or technical grounds. Deptt has option to intiate disciplinary proceedings pending criminal trial.
