(Querist) 10 May 2012 This query is : Resolved 
accused gave statement to give cheque amonut in 2 installments in the court and now he says he has no money to give ist installment.case is on DW .what court will do and what accused can do .does it means the pleading of guilt by accused and will he has right to appeal

Dear Mr.Singh,

Any oral testimony is valid only if it is recorded in the court.Proceed as per the court formalities as the accused has failed to pay.If you give him another chance,you will be the looser.

His request for time to pay the amount in two installments amounts to acceptance of his guilt. If the accused fails to pay the amounts in the installments permitted by the court, the court should convict and sentence him as per then povisions of the Act.The accused can go in appeal against the conviction and the quantum of punishment imposed by the court.
