Verification of plaint

(Querist) 07 May 2012 This query is : Resolved
if any error committed in verification of pliant then will it be fatal to the suit.
how it can be corrected
Adv.R.P.Chugh (Expert) 08 May 2012
Certainly not fatal. All such errors can be amended u/o 6 R 17. The Court further has the power to itself correct the necessary changes in proceedings u/s 153 etc. though the same is less likely to be exercised.

I agree with Bharat Chugh.

You can get amend the plaint, but the amendment should not change the nature of the suit. If amendment changes the nature of the suit then amendment application will be dismissed.

I agree with Ld. Chugh.

To avoid multiplicity of Litigation, Amendment is allowed .
v/F is a cut & paste paragraph, and you being practising Advocate for years, This seems a unusual Query.
