I have applied for “validation” of a Sale Deed (un-registered) which was executed on dated 10-12-2005, on a Rs.100/- stamp paper, before the Registration Officer of the concerned. As per the procedure, they made an official enquiry about the genuineous of the stamp paper and after receipt a report from the concerned department, they will allow my application for further process.
But in my case, what was happened, the concerned officer made an endorsement that the required register is not found in his office.
So at this movement, what the officials will take further steps in this regard. In the absence of record, how I will prove that my stamp paper is genuine. Who will have the burden of proof.
Plz. Clarify.

Dear Querist
burden of proof lies upon the concerned officers.

It is for them to prove otherwise.
