Legal metrology

We have started importing ‘Product A’ from a foreign manufacturer and affix proper declarations as required under the Legal Metrology (LM) rules on such products.

Prior to us, there were other importers who were importing from the same manufacturer, however, they never followed the LM rules for declarations. Such products without declarations still exist with many distributors with whom we have tie-ups.

If they are seized by the LM department at the distributor’s place, will we be held responsible?

Suppose we have sold 10 genuine products to the distributor and 5 are sold by him. He may have 5 more illegal products which are without declarations. How do we prove that they don’t belong to us?

Pls guide.

when you supply genuine products with declaration the products must be containing detailed particulars as to month of manufacture ,, batch number .

be extra careful when you supply goods to distributor . enter into proper agreement with distributor mentoning detailed particualrs of goods supplied

Unless stock with you is found without certificate/ proper measurements recorded in the custody of your company you cannot be held responsible for the stock available with the retailers or the goods in use with customers. Retailers themselves would be responsible to get themselves registered as dealers under LMA. It would however be better, if you distribute/sell the products only to the registered dealers under the LMA.
