Disqualification of property.

(Querist) 21 April 2012 This query is : Resolved 
Mr. A is holding possession of property before the year 1995. shop comes under the tenancy rights after some years in Year 1998 shop was transferred to Mr. B who is brother of Mr. A, transfer took place only changing the name of Transferee in transfer receipt... Mr. B also transferred the electricity bill in his name. Now the development is taking place in the area where shop is situated and builder has sent the notice that this shop is disqualified according to records of MAHADA, however landlord said to MR. B that he has to give any original documents of year before 1995 or any proof of agreement if transfer took place after 1995 to qualified the shop for development.

Now Mr. A has prepared the affidavit stating that Property belongs to MR. B and he (Mr. A)has transferred the shop in the year 1998.

My query is that Affidavit prepared by Mr. A will be accepted by MAHADA authority or any other requirement to be full filled??

I appreciate your views in this query.

you will have to cross check with MHADA . go to MHADA office along with necessary papers . point out that MR A was in posession before 1995 and as per family settlement shop was transferred in name of B real brother of A

thank you Ajay sir for your suggestion..so affidavit sign by Mr. A, electricity bills and rent receipt, will be sufficient or needs to have other documents also??
