my query is if the employer remains exparte before the commissioner can the commissioner award compensation to the employee when he has failed to establish he is the employee of the employer. can the commissoner look into any other evidence to prove that the claimant was an employee like FIR etc

yes he may award the comepnsation, becauuse no body will be contest the case

If the employer refuse to follow the award which is given by commissioner then it is breach of order. So the commisoer can send attachment of property or leavy fine with interest

Commissioner has to satisfy that thee is relation of Employer and Employee between the parties and the cause of death /or/ injury to be considered and satisfied by the Commissioner to Award Compensation . The FIR , Pay Rolls and Employee Identification Card and other connected matter to be considered.
