Proper time to submit the documents.

(Querist) 21 March 2012 This query is : Resolved 
sir,
can the plaintiff, is permissible to submit the documents relating to property in question, at the time of arguments?.
if is,

what are its merits and demerits, when compared to the documents, which plaintiff, submitted before the trial begins,

awaiting your valuable suggestion in this regard.

All documents on which you are relying has to be submitted along with plaint.

The same would later be exhibited.

once evidence has been closed how can documents be submitted ? case is for arguments only . you have to argue on basis of evidence on record .


if however you have failed to place important documents make an application for placing addtonal evidence on record .

The documents must be produced at the proper time by the proper person from proper custody. Just because the documents are produced, the court will not, probably should not look into them unless they are brought on record through witnesses by marking them.

to place important documents, Apply for placing addtonal evidence on record ., with valid reasons, and court have inherent power u/s 151 cpc , in the interest of justice to allow to exhibit doc produced, with right to cross.

It depends on pleasure of court, after hearing the parties to suit.

Yes. Fresh petition for filing additinal documents to be filed and if court convinces that there is reasons sufficient showing that your failure to file the documents at filing of plaint if reasonable then may allow the petition and then you can mark it.

plaintiff will have to file application

for adducing additional evidence in court

and if court allows it then only he can file

documents at the time of arguments.
