Shailesh Kr. Shah (Expert) 25 January 2012
Prima Facie "no", however, It depends upon also other facts also.... say that she have maintain herself from rs.12000/=.
O. Mahalakshmi (Expert) 25 January 2012
She can file for her son and daughter maintenance basing present cost of living.
Shonee Kapoor (Expert) 26 January 2012
Yes she can, but would be rarely granted.

However maintenance of the child need to be paid and it can be shared between wife and the husband in proportion to their earnings.

Study Padamja Sharma case for the same.

From where SON came in picture?? not in Query.

Mr Barman added son,
Now Mahalakshmi added daughter also??

ANS: No maintenance for Wife, Unless she is homeless, and Hussy have property, then in DV, can claim for shared household and residence.

If children , 50% of their Mtn cost, say Rs. 3k pm, for each one.
