SONS OF PREDECEASED SON

(Querist) 09 May 2009 This query is : Resolved 
A muslim Father died leving his estate with wife, 3 females and 1 male live heirs. Eldest Son died before this father die(predeceased son). Now my question is according to Muslim law, can the grandsons/daughters of this Muslim father ( i.e. the sons and daughters of predeceased) have rights in thier grand father's estate or not? Kindly reply as quickly as possible.

Grandsons and daughters are not entittled to any share in the grandfather's property.
SEC 139 of Mohd., law : Rule of exclusion of sharers will be applicable.
In this case son is died before the death of the father, so when son is dead only the live sharers will get share in the father's property. In ur question only the live successors are 3 females and 1 son. For the calcuation of share always male member will doluble the female members so each females will get 1/3rd share and male will get 2/3 share in the property of deceased father.
