498a - anticipatory bail

Hello All

My wife has complained against me in women cell at Ludhiana(Punjab)charging me of 498A, 406 etc.

Should i apply for anticipatory bail. No F.I.R has been registered against me, so whether i will be getting anticipatory bail or notice bail or blanket bail.

What if, i have been refused above.

1. Is it just 406 or 120-B too along with it.

Please explain the Etc.

2. If no FIR has been registered then i recommend Notice Bail. For Notice Bail you have to file an Anticipatory Bail in court citing any document that shows that there is a complaint pending against you. The judge at his discretion can then grant you a notice bail which is a time period given to you after the cops give you a notice of arrest.

3. How many years of marriage has it been??

Sir, the main case is under 498a, 406. They have also claimed for 307 that is another matter. Not 120-B or so as per my knowledge. Does above section makes any special difference. Kindly guide.

Also, its been 3 years since we got married.

Dear you can approach the high court or court of session for AB. feel free to call

1. File for AB in Sessions Court, normally you would get notice bail. If denied, move HC.

2. Where are you from, If from a diffirent city, you can get Transit bail as well.

Application for Anticipatory bail in Sessions Court is the only option.
