(Querist) 22 August 2011 This query is : Resolved
Can private person make appeal against acquittal who was original complainant in state case?
Murali Krishna (Expert) 22 August 2011
Yes. There are many judgements. Refer to Narendra Nath Khaware Vs. Parasnath Khaware and Ors, (2003)5 SCC 488 and Ramakant Rai Vs. Madan Rai and Ors,(2003)12 SCC 395.
sachin sethi (Expert) 22 August 2011
yes, after the definition of VICTIM being added in Cr. P. C. in section 2 (wa) an appeal against acquittal can be filed by victim of offence..it doesn't make out a difference that state has not opted to file an appeal...even a victim can file a revision before High Court for enhancement of sentence of accused if improperly sentenced by the trial court....
Advocate. Arunagiri (Expert) 22 August 2011
The defacto complainant is having all rights to prefer the appeal, if the state is not doing so.
SANJAY GUPTA (Expert) 22 August 2011
I agree with the experts.
