Dear Professionals,

We have got 1 house on my dad's name & he is planning to sell it off.My mother & brother both are staying along with my dad in the same house.The fact is my dad is not loyal with my mom right from early days of their marriage.Now if they sell off this flat & go away then what kind of safety my mom can avail so as to protect her right as a lawful wife.

isuue notice stating that you along with your dad is the rightful owner and contains right over the property which cannot be sold without your consent and nmoms. or else you have to move to court which is last restort afyter issuing notice.

Take help of Domestic violence Act. This the only Act in India vide which such women may seek stay order against her husband o dispose off his immoveable properties even though it may be his self acquired. So immediately file an application under section 12 of Prevention of Violence against Women Act, 2005 before concerned judicial magistrate.

Your query need some more details.. You didn't stated about that you are son or daughter, also where is your mother now, is she living together with your dad or not? And about property. Whether its ancestral or self acquired?
