THEFT CASE UNDER ELECTRICITY ACT

1..Theft case framed based on meter seal broken, tempered without giving any opportunity to accused to put his defence by electricity department and further told to deposit penalty. Is it a consumer court case against electricity board for negligence of services and settled position of law on this subject

how is the electricity board negligent ? there is no deficncy in service by electricity board . case has been lodged by electricity board against you for tampering with meter

You can file a petition before consumer reddressal forum which are constituted for this type of cases relating to theft of energy cases. You can get further details from the electricity board concerned.

If you have sufficient grounds to rebut the allegations of electricity board then get it challenged before DCDRF as this is a consumer case. You shall to plead that no photography was got done, no independent witness involved, no opportunity of hearing provided and so on. I have defended various cases of similar nature in DCDRF.
