Resignation

Querist : Anonymous (Querist) 21 July 2011 This query is : Resolved 
if a govt employee ask for permission to pursue education or choose a career from his employer and the employer rejects the application then what can be done; i think

1. as per the fundamental rights given to us we are free to choose career and pursue education but

2. but there are conduct rules in govt which prevent us to do the same

i want to ask whether conduct rules in force can supercede the constitutional rights of a citizen in india.

Dear Anonymous,

Constitution gives right to freedom.
I can sleep upto 12 noon and nobody can do anything to me.

But If I join employment, then I have to be in my office at 9.00 a.m.

Can the Government insist that I should be at office at 9.00 a.m. and curtain my fundamental right to sleep upto 12 noon?

Therefore, each of the rights, whether fundamental, legal, constitutional etc., etc., are all circumsbried by context and situations.
