I would like to know is there any Supreme Court judgment or solid legal document that specify number of working hours in a week of any contractual/temporary office working employee in a state or central government.

in both acts i.e, shop and commercial establishment act as well as in factories act, no employee can be forced to work more than 48 hours in a week and 8 hours in day . in case more than 8 hours work are taken by the employer in day, the employee is entitle for wages for the period worked in excess of 8 hours at double rate of his ordinary wages.

What is the philosophy behind 5 days week, working hours? 8*5=40 hrs. & not 48 hrs. as specified by the experts.

5 days working is in only in few Central Government Offices in which neither Shop and Commercial Establishment nor factories Act applicable. They have their own rules. Moreover their working hours are more then 8 hours i.e. 9.30 hours in a day. i.e. not more than 48 hours in week.

How come in IT industry people work 10-16 hours daily? Is the shift duty should also 8 hrs?

if working hours are in IT industry, the same is illegal.An industry can have shift working but it can not take more than 48 hours in week and 8 hours in day. For excess work,the employees are entitled for overtime wages. They can raise their grievances before appropriate forum.

Thanks to all the experts.
Since shift duty is considered as un-natural working hours, therefore the shift duty will be 6 hours per day.
Is it right???
Since our constitution is a written constitution, where I can find the rules on working hours???
