Contradictory Oral evidence

(Querist) 20 June 2011 This query is : Resolved
I and my family are accused of false dowry harrasment case.
Girl was never harmed in any way, mentally or phyiscally.
I want your help in understand, how court would determine truth when oral evidence given by wife and her family differ from husband and family.

Does being an accuse undermine one oral evidence ?
M.Sheik Mohammed Ali (Expert) 20 June 2011
its not valid one evidence, the court expect primary evidence.
Devajyoti Barman (Expert) 20 June 2011
Oral evidence is primary evidence but the point is the court after weighing all the evidence is guided by the rule of criminal jurisprudence which tells that the case must be proved beyond reasonable doubt.
Kiran Kumar (Expert) 20 June 2011
Mr. Barman is quite right that the allegations are to be proved beyond reasonable doubt.

every case has its own merits, there are no set parameters for assessment of evidence. court will analyse the truth from oral as well as documentary evidence.

you will get enough opportunity to rebut their allegations.
