Property sold by third party

Sir,

My grand father's cultivated land was sold by one of our relatives 5 years back. but not registered. They got money for that land and signed in agreement too. Now, person (who gave money for that land) is cultivating that land. If I want to take action on buyer and seller, under what are the sections I can take action on him.

If you have documentary proof, then can file criminal case.

Otherwise you can file only a suit for recovery of possession

you cannot do anything now because agreement of sale is time barred and sale deed is also you don't have. To claim the tittle you should have tittle over the property.

Thanks for your reply from Aravindhan sir and Rajoo sir. In this agreement, 17 members have to be signed. But now only 3 people have been signed.
