when money subject of litigation

(Querist) 20 March 2011 This query is : Resolved 
after sale of ancestral property, if the children of the seller(hindu family), ask for their share in the money what is the course they should adopt?

if we ask for our father's account sealing, can our father be compelled to give his account details?
is there some other remedy?

cannot the amount be submitted to the court till the case is resolved?

son can ask for his share in the share of his father in the ancestral property.

The children need not ask for share of money. The transfer itself being invalid they can seek the declaration of the court to term the sale deed as null and void.

Dear Mr. Tilak,
First and foremost I have a doubt whether the property is ancestral. It is not clear on what basis you say that the property is ancestral. If it had been ancestral, your father could not have sold it and the buyer would not have bought it without obtaining the consent / signature of the claimants like you. So better be clear whether the property is 'ancestral' and the basis for saying so.
