My uncle has been convicted in a case of 420,468 and 471 from Tis Hazari Court in August 2010 for 5 years and currently in Tihar in RI.We have applied for the appeal in high court in September and the appeal date was on 8th March.We applied for the bail but the judge said that minimum 10% of the RI is required for the bail.on 8th March too,Judge Hema Kohli said that she is not conviced for the Bail application as just 7 months have completed in Jail.She has given a date of 11 jule for the bail application.I would like to know if we can reject the bail in high court and apply for the bail in supreme court ,in how many days can we recieve the date for bail application?and if bail application is also rejected in Supreme oourt then we can reapply in high court for the same?what are the chances in Supreme court for the bail?

It is better to get bail from High Court on 11 July instud of going to Supreme Court,where bail is hardly to be granted before a year from conviction in such a cases.

11 July is Over and we have not recieved any bail in the High Court.This time the judge was V K Shaily.He was previously saying that since 1 year is not complete .on 8th March the reason was CBI was not presented their file but now there was no reason for bail rejection.Our Lawyer discussed on the points on the bail however the file for lower court was not there for the exhibit.We have given 29th August date.I am unable to understand why Judges are not convinced and what if on 29th also we will not recieve any bail due to any other reason?This seems that Court is also involved with CBI for not letting us bailed.We are feelig helpless as we have not recieved interim bail either.People from Murder,rape cases are being getting bailed.Is it only lawyer who needs to get the person bailed?cant any good point about the victim save his life?why cant we allowed bail?Its almost a year since 17th August 2010.
