Shall I file the Appeal/complaint application before the Information Commission?

Sir,
I am terminated from services on 20/11/2010 and the employer refused to serve me the copy of ordef and I file the RTI application under RTI Application where I was asked to deposit Rs 20/- as photocopy charges for the order
I send Via IPO and I didnot recceive the reply then on 22/12/2010 I made an appeal before the Appellate Authority

I think my employer is delaying the process, Shall I file the Complaint Application before the Central Information Commission on 31/12/2010 or wait for another couple of days for the same
Whether my move under section 18 of RTI is justified?

I think you should wait because you have already filed appeal.

The second appeal can be filed after the expiry of 30 days of filing 1st appeal.

the second appeal could be filed within 90 days.

so it is better to wait some more time.

morever,the cic takes around 18 months to attend your case because of the heavy work load there. further,the act does not stipulate any time limits for the decision in second appeal.

According to RTI act, The Act specifies time limits for replying to the request.
If the request has been made to the PIO, the reply is to be given within 30 days of receipt.
If the request has been made to an APIO, the reply is to be given within 35 days of receipt.
If the PIO transfers the request to another public authority (better concerned with the information requested), the time allowed to reply is 30 days but computed from the day after it is received by the PIO of the transferee authority.
If information is not provided within this period, it is treated as deemed refusal. Refusal with or without reasons may be ground for appeal or complain

Hence you have to wait for getting the reply.
