Procedure to be followed for transfer of employees within group companies

(Querist) 17 December 2010 This query is : Resolved
Hi,

Please let me know the Procedure to be followed for transfer of employees within group companies & the checklist to be followed for the same.

Raj Kumar Makkad (Expert) 17 December 2010
If within service conditions of the employees then simply issue transfer orders and if no such condition to transfer within the group companies exist then insert this condition by notifying specifically and obtain the acceptance of the relevant employees then execute your orders as submitted above. So far following the checkelist is concerned, documents showing qualification, appointment, attendance, service record, subsequent notification, acceptance of notification, service agreement, transfer order should be annexed.

Nice explanation by Mr.Makkad.

Transfer is an implied condition of service unless the service conditions prohibit so. A transfer even allowed by service conditions can not be made with malafide intention, to victimise a workman, to alter his service conditions or prospects, change in nature of job or status. Another important point is that an employee can not be transfered to another employer permanently however services of an employee can be lent to other employer without snapping the master/service relation.
