Relieving Letter

Hi,
I have joined infinite solution on 3rd may.I have resigned on 31st aug 2010.I have served 12 days notice period which was 30 day .I submitted my resigantion I did not get confirmation for the mail.I just verbally with Team leader.He said it is accepted.After 11 times to door steps for Finally after 2 month They asking me to pay recoverable amount 15k for remaining days.But nothing was informed before resignation My company would brought notice period or i would request my joining company to extend Joining date.I am left with 28 Paid leave,Will it be adjust in notice period.or they could witheld my salary for final settlement.Please let me know how to go about.

If thwre was a ckause in the job contract that the notice period will have to be served in default of which salary would be deducted to make good the loss then you have no option. The paid leave can only be adjusted if you have served at leat 6 months in the company.
Anyway, the erstwhile employer will have to file a suit for recovering that amount and if you have already joind in the new company then do not reply to those letters unless you are agreeable to give them the said amount of money.

You mean to say I need to pay the amount to get my releving letter.

What are all the termination conditions in your company?

You admitting just 12 days notice you gave for which the company rules specify 30 days. then you need to pay compensation

after resignation of an employee from service, the employer has nothing to compel the employee to fulfill any requirement, which he want except to withheld his terminal dues and not to issue revealing order. it is the employee's problem how to deal with the condition. in case, he is in acute need of revealing order, he will fulfill the employer wish, otherwise either he can ignore or can seek legal assistance. however, he has a right to claim terminal dues, which the employer can not withheld under the law.

Thank For Advise.As nothing is left except pay and get releving letter.

These are Sequence events that made me change job.
1.These were not sure of process they took my interview for server support.Finally it Voice based techsupport.

2.Some how i managed as i had no other option they started put pressure for sale support.that reason i decide to leave my premanant job and opt for contractor job.
