Expediting justice in Courts

(Querist) 02 November 2010 This query is : Resolved
Message :
Why officials and officers of the Courts should not be held answerable, who delibrately delay justice using illegal tactics ?
They needs severe punishment for wasting valuable time of the Hon'ble Courts, which costs to the nation appox @ Rs. 8000/- a minute.

Devajyoti Barman (Expert) 02 November 2010
If you think that there is extraneous reasons for the inordinate delay of your case , then you can apply before the Chief Justice for transfer of this case to any other Bench. You can also pray for expeditious hearing of the case at that time.

Ask your advocate to make necessary representation to the court. There is no point in your lamenting outside the court like this. Senior Advocates need not file vakalat at all. Do not make such unwarranted comments against the Advocates on the opposite side. You say"he calls himself senior advocate". It is highly objectionable. Nobody can style himself like that. It is by a process of designation that an advocate is made a senior advocate. You cannot expect the advocate on the opposite side to aid your case or dance to your tunes. He is expected to do his best for his client. Advise your advocate to be a little more vigilant and active. Then only you can see the light of the day. Till then start this blame game. Act as per the advice of Mr.Barman.

First of all there must be some problem with your side of story since whatever the delay due to any reason the opposite side has to pay dues with damages. And opposite side is aware of this.

Most of the people expect the system to work like an electric button which is not possible and does not exist any where.

So instead of blame game be ready and prepare your side well , if you are right you will get dues with damages for time consumed.

If you persist with blaming only you may end up facing criminal action.

Engage a Senior Advocate from your side He is the one that suit your wish for.

Mumbai HC is fully computerized. Cases are taken up strictly in chronological order, unless the concerned parties obtain orders for out of order hearing. Please discuss with your Advocate and take steps for early hearing of the case. For this you have to show special circumstances supporting early hearing.
