Certainly the attorney can file the divorce petition but can not depose on behalf of the Principal.
Kirti Kar Tripathi (Expert) 17 October 2010
no. the petition must contain the signature of party but it can be presented by an advocate. in family matters appearance is necessary at the time of presentation of a petition before the family court.
Devajyoti Barman (Expert) 18 October 2010
Mr Tripathi you are talking about cases before the Family Court. But before the court of the District Judge the personal presence of the parties never required except at the time of reconciliation and evidence and here the cases can be be filed by the attorney very much.
