Time limit for filing writ petition

Ld counsels,


In a RTI matter the state information commission had passed an order in February 2010.

If the RTI applicant prefers a appeal against the order before the HC what is the time limit to file a writ before HC.

Please clarify.

There is no fixed time limit for preferring the Writ Petition. But Writ jurisdiction being discretionary relief, Courts normally expect the aggrieved party to come before it without losing time. The Court does not come to the rescue of those who sleep over their right. So long as Courts do not consider there is any latches in preferring the writ, one can file the writ.

you may approach the H.C. with in a period fo 60 days thers after you may file it with S.5 of the Limitation Act.
