How far an ordinary citizen can go in case his opponent is a Advocate. Pl provide step wise detail information.
R.Ramachandran (Expert) 07 October 2010
As far as the parties to the litigation is concerned there is no difference whether the opponent is an Advocate or any one. A party can go to fullest extent without any difficulty. Just because the opponent is an Advocate, it does not mean that he will have any advantage or that the court will favour him. The court will decide the matters on the basis of facts and law and the evidence produced by it and not by whether any party is an Advocate or not. For example, only yesterday, the Supreme Court has upheld the conviction of Mr. Santosh Kumar who is an Advocate. So whether a party is an Advocate or not has no relevance.
