tenant denying ownership of landlord

Querist : Anonymous (Querist) 24 September 2010 This query is : Resolved
Dear sir

I need some citations on eviction due to conduct of tenant and tenant denying title of landlord.
H. S. Thukral (Expert) 24 September 2010
The existence of relation of tenant and landlord is an essential condition of lease. Denial of title of landlord results in forfeiture of lease as per TPA. Beside that the tenant is estopped from denying the title of the landlord in the beginning ( Sec 116 Indian Evidence Act)
There are so many judgments of the Apex Court in this regard. Look into section 116 of the I.E. Act. If you can not find revert back to me.

Very rightly advised.
