my uncle is intending to make a will but his question is that can he take the signature of his wife's brother as a witness (family member) on that will ,plz suggest me
prabhakar singh (Expert) 28 December 2013
YES HE CAN!
BUT IF HE OR HIS SISTER IS BENEFICIARY BETTER TO AVOID HIS SIGNATURE AS ATTESTING WITNESS.

Why is your uncle insisting his wife's brother as witness to the WILL, is not your uncle having full rights over the properties he intends to bequeath through the said Will ?, then why is he insisting so, if he is not a beneficiary in the Will, he may sign as witness.
ajay sethi (Expert) 29 December 2013
it is advisable to have doctor and lawyer as attesting witnesses . avoid having wife brother as attesting witness
