I owned a housing flat in Co-op Housing society in Mumbai, Maharashtra. I am planning to sell and I submit the letter to society for NOC so that I can sell. Society refused to give me a letter because there is a inquiry from the IT Department about my Father's pending Case. The flat is under my name and I have nothing to do with my Fathers IT case, IT didn't stop the society to transfer the above Flat but they just inquired for the ownership of the Flat. What are my options to get NOC from the society so that I can sell. ??

Issue legal notice to the society stating the true facts and request them for NOC.

The Society should give you the NOC.
If it refuses to do so then lodge complaint with Registrar of Society.

submit another letter stating the details that you are about to sell and the details of your father case also and also mention that it is on your name and issue NOC within a week if not will take legal action and also will complain to registrar of society

NO NOC needed from CHS for transfer of flat by owner is legally required.It is a bogus practice. CHS is formed only to take care of common area of the building belonging to all.
