First of all i would like all expert for their valluable suggestion.
sir,
as for my safety i have recorded conversation between me & my friend in which he is saying that you will get you amount invested when i will receive the same from the department.
sir, but i asked his to give post dated check for the same amount he is not ready for the same.
sir,should i belive him for the same or not,or should i file F.I.R FOR THE SAME

if he is not refund your amount then file a case, before send the notice, and as per evidence act your recorded electronics media evidence is admissible.

The recorded conversation is enough to prove the liability.
But, as of now, there in no other way than to wait for your friend to return money.

firsyt address emails to your friend drawing his attention to promises made of issuing cheque . wait for his repsonse .send reminders . build up a case

FIR cannot be filed in the given case as this is only a civil matter of business. If you fail to get the due award only then you have cause of action in your favour. You are in a hurry.
Why did you not shown your such hurriness when you were investing your money in the hands of your friend?

It is not sufficient for criminal case. You should have executed a agreement to fix his liability.
You at best can file a suit for recovery of money.

yes., n.i act can can not cover under penal provisions..
you have two options..
for punish him, you can file complaint under sec.138 n.i act., [if cheque is dishonored mean]
or file a suit for recovery of your money..

Its a civil matter and not criminal.
