Domestic violence and dowry issue

(Querist) 07 October 2016 This query is : Resolved
Hi, my name is Sonia. I have been married since Feb 19 2013. Ours was a love marriage. Marriage was done with both the family s blessings. But my in laws didnot like me but as my husband was the only earning member at that time they agreed for the marriage. After marriage there were many family issues at home everyday. My husband started listening to his patents more than me. Domestic violence and dowry issues arose and became a daily issue. After 1 and a half year, we separated from my in laws. My husband keeps on torturing me verbally and physically saying that you have separated me from my family. Last august 2016, he beaten me and since I had lost patience, I did a police complain. My husband eloped from there. Its been 2 months now he has left his job and sitting at his moms place. Now he is not lifting my phone and doesn't want to talk me as well. I am staying at my moms place. I have a 2 and a half years old daughter. I don't know what to do. I do not want to divorce him. Please suggest me what to do?

You should file police case under 498a and other provisions of law. No need to provisions in detail. Just write about your grievance and pain in detail (express your painful feelings in the complaint). There is lot of woman protection law in our country. Nothing to worry. Just get ready. You are also entitled for maintenance. Also file a Domestic violence case. He will come to terms and then you can decide whether to live with him

1. For 498A, details are required to be mentioned at the first instance otherwise there are chances of disputes whether something said after is an "afterthought".

2. Give a very serious thought before filing case under 498A.

File section 498 A and DV case against your husband. May be he will mend his ways.

Why to repeat?
Guest (Expert) 08 October 2016
498A & DV case never makes any mend, rather infuriates husbnad and his family. In the trial, lives of both parties get ruined. While, husband and his family is ruined forever, the wife never gets an honourable place in the society even on remarriage.

Better take help of elders of both sides for patch up.

Mutual adjustment is a must in family life.

Discuss and reconcile the issues with your husband and in-laws, do not adventure to resort to legal option if you have guts to save/continue and enjoy matrimonial life.

There is hardly any point in repeating same story time and again, which is absurd and ridiculous. It is wastage of time and efforts of the professional experts who have advised you adequately without charging any fees in your original thread, which you would not find any change in the opinion. Besides this, they are time pressed even then providing FREE LEGAL service to needy litigants.

I concur with precise words of DR. J C Vashista.

Try to save the marriage.
